Legal consultant

1. Background

FPA Sri Lanka has an existing Safeguarding Policy that aims to protect children, young people, beneficiaries, staff, volunteers, and partners from abuse, exploitation, harassment, and other forms of harm. FPA seeks legal expertise to review the policy and ensure its compliance with the Sri Lankan legal and regulatory framework.

2. Objective

To review the existing FPA Sri Lanka Safeguarding Policy and provide recommendations to ensure it is legally compliant, relevant, and aligned with applicable laws and safeguarding requirements in Sri Lanka.

3. Scope of Work

  • Review the current FPA Sri Lanka Safeguarding Policy and related procedures.
  • Assess compliance with relevant Sri Lankan legislation and regulations relating to child protection, sexual harassment, labor, data protection, and reporting obligations.
  • Identify legal gaps, risks, or inconsistencies.
  • Recommend amendments to strengthen legal compliance and implementation.
  • Provide legal input to revise the policy where required.
  • Submit a final review report outlining findings and recommendations.

4. Deliverables

  1. A brief written review of the existing Safeguarding Policy, indicating whether the policy is aligned with relevant Sri Lankan laws and regulations.
  2. A summary of legal gaps, risks, inconsistencies, or missing provisions in the existing policy, with practical recommendations for improvement.
  3. A revised or marked-up version of the Safeguarding Policy showing the proposed legal amendments, additions, or clarifications, where required.
  4. A final report summarizing the review process, key legal findings, recommended amendments, and actions required for FPA Sri Lanka to strengthen legal compliance

5. Duration

One month.

6. Required Qualifications

  • Attorney-at-Law qualified to practice in Sri Lanka.
  • Demonstrated experience in policy review and legal compliance.
  • Knowledge of child protection, safeguarding, labor, and non-profit sector regulations in Sri Lanka.
  • Experience working with NGOs, development organizations, or international agencies is an advantage.

7. Payments / Considerations

The applicant shall submit a financial proposal together with an effort estimation, indicating the expected number of working days required to complete each deliverable. Payment shall be made upon satisfactory completion and acceptance of deliverables by FPA Sri Lanka. Payments will be made in two instalments as follows.

Upon submission of the Legal Review Note and Legal Gap Analysis = 40%

Upon submission and acceptance of the Revised Safeguarding Policy and Final Legal Review Report = 60%

All payments shall be subject to applicable taxes and FPA Sri Lanka’s financial procedures.

8. Reporting

The consultant will report to the designated FPA Sri Lanka focal point and submit all deliverables within the one-month assignment period.
